Environmental Scoping ReportFor Road 2382 - Report Number 1896 (Volume1/1)

REQUEST FOR SECOND PUBLIC MEETING

Recognizing the need for improved transport infrastructure, and forgood planning, the Interested and Affected Parties (I&APs) call fora second meeting to be held at a suitable time, during office hours, aswe need to resolve a number of issues as a matter of urgency.

Please refer to your e-mail dated 12th July 2005 that reads:

"We have tried numerously to get feedback from Gautrans on the legalityof Road 2382 but up to date have not received any feedback. ....We haveamended the Scoping Report for the proposed Road 2382 to address the commentsreceived from interested and affected parties after the review of the ScopingReport. The amended Scoping Report will be available for review by interestedand affected parties for a period of one month. ..Date: 12 July 2005 -12 August 2005"

Issue 1) Gauteng Transport Infrastructure Act 8 of 2001 and otherRelevant Legislation

The above legislation is critical to the affected land owners and inview of its complexity the I&APs request that Bokamoso appoint an IndependentSpecialist Consultant (ISC). The ISC must be qualified to advise on thisapplication's compliance with all applicable legislation and to advisethe I&APs of their rights and obligations in terms of current legislation.We suggest urgent consideration be given to identifying experts who havethe necessary professional qualifications to assess and advise on thismatter.

Issue 2) Legal Status of Road2382 and the extension of Road 2382

We cannot understand why Gautranswill not give us written confirmation of the legal status of Road 2382and legal status of the extension of Road 2382 to the south of Doornkloof.We asked, at the public meeting, that the speed of vehicles using thisroad be restricted by means of road signs and speed bumps. This will reducedust and improve safety. Gautrans responded by saying Road 2382 was a Provincialroad and the speed cannot be reduced below 100 km/hour. We have been advisedthat the 'appropriate' authority must take action to ensure road safety.Clearly this matter needs urgent attention.

Issue 3) Amended EnvironmentalScoping Report For Road 2382

Having studied the Amended EnvironmentalScoping Report For Road 2382 we find that a number of important Key Issues,raised by Interested and Affected Parties (I&APs), have NOT been includedin the report and those that were included have NOT been adequately addressed.

We again ask that ALLof the e-mail letters detailing the key issues listed below be included,and addressed, in the Scoping Report AND tabled for discussion at the PublicMeeting.

KEY ISSUES

E-mail letter to Bokamoso - NickOosthuizen
Alternative solution to the dustproblem - proposed on behalf of Interested and Affected Parties (I&APs)by Nick Oosthuizen. The proposals as set out in the above Scoping Reportwill only solve a very small part of the problem and add further problemsto the equation. It is imperative that ALL concerned parties understandthat both the Road 2382 and Road 2383 are causing a serious dust and mudproblem impacting on health and road safety of residents in the local areaAND the safety of users of the R21, M57, Road 2382 and Road 2383.

E-mail letter to Bokamoso (L4)
REQUEST FOR SECOND PUBLIC MEETING- ROAD 2382. Please refer to the Public Meeting held on the 30/09/04 atPLOT 160, HWJ Timber Traders, Doornkloof East. The Interested and AffectedParties (I&APs) call for a second meeting to be held at the same venue,at a suitable time, during office hours. The e-mail requesting the meetingincludes a list of IMPORTANT ITEMS THAT NEED TO BE ON THE AGENDA.

E-mail letter to Bokamoso (L3)
Alternatives Routes: 'Route 9' and'Route 10' are proposed by Interested and Affected Parties (I&APs).'Route 10', the modification and upgrading of the existing Provincial RoadP122-2 (M57), must become an option and given serious consideration. Theproposed alternatives 'Route 9' and 'Route 10' are the only options thatwill not have a major noise impact on the residential area, located onthe long ridge, to the east of the R21. ALL of the routes (Routes 1-7)proposed in the Scoping Report Number 1896 will result in an intolerablenoise impact on this residential area. The residents on the 'long ridge'are being asked to exchange intolerable levels of dust from the road forintolerable levels of road noise. Clearly both options are unacceptableand an equitable solution to the problem must be found.

E-mail letter to Bokamoso (L2)
Should this road go ahead, as proposedin Scoping Report Number 1896, properties to the east of road R2382 (SterkfonteinAvenue) will no longer be suitable for residential purposes due to thevery high level of vehicle noise. The projected noise level on the propertieswould be far in excess of 55 dBA. The WHO guideline states that at noiselevels of 55 dBA, and above, serious annoyance occurs and speech becomesdifficult. This major noise impact, on a residential area, is clearly a'FATAL FLAW' in all of the proposed routes numbered 1-7. The Interestedand Affected Parties (I&APs) are asking that a qualified acousticianaddress ALL of the possible routes, give consideration to the use of substantialearth berms, and calculate present, and future, noise impact contours forALL of the properties. As road noise will be a very important aspect ofthe Environmental Impact Assessment the I&APs must be involved in theappointment of the acoustician.

E-mail letter to Bokamoso (L1)
Legal status of Road 2382 to beestablished. Sterkfontein Avenue has, by default, become a through roadwith ever increasing traffic, extremely dangerous curves and a VERY seriousdust problem. The Interested and Affected Parties (I&APs) are stillwaiting for a written response from GAUTENG DEPARTMENT OF ROADS definingthe legal status of Roads 2382 and 2383 AND the legality of the extensionof Road 2382 beyond the original servitude roads shown on the attachedmap (See Index to FIGS: 1). This matter was raised at the public meetingand the GAUTENG DEPARTMENT OF ROADS' (GDR) written response should havebeen included in the Scoping Report. The I&APs ask that GDR's writtenresponse be made part of the addendum to Environmental Scoping Report (Number1896 Volume1/1) as a matter of urgency.

MEETING WITH LAND OWNER (DV LARSEN)TO DISCUSS IMPACT OF ROAD ON RADIO MASTS AND RADIO STATION - GAUTENG PROVINCIALGOVERNMENT: DEPARTMENT OF PUBLIC TRANSPORT, ROADS AND WORKS & NYELETICONSULTING. A section of Sterkfontein Avenue (R2382) is located on a servitudeacross Mr Larsen's property and is very close to the Salbu ExperimentalRadio Station radio masts. This servitude serves a number of purposes andMUST not become part of a GAUTRANS road reserve. (.....Notarial deed ofservitude K 1686/1966 S dated the 15th NOVEMBER, 1966, and registered onthe 28th DECEMBER, 1966, the property hereby transferred is subject toa perpetual servitude of rights of way 15,74 metres wide in favour of thegeneral public, as will more fully appear from the said notarial deed andwhich servitude is represented by the figures A s t F and C D v u on theannexed diagram S.G. No A 3158/2001....)

IMPORTANT ITEMS THAT NEED TO BEON THE AGENDA:

1) Confirmation of minutes of lastmeeting.

2) Matters arising out of the aboveminutes.

3) Matters arising out of the Minutesof Meeting held on 2 March 2004:  The minutes are headed "Preliminary Designof Road 2382 between roads K220 and K54, and Road 2383 between Road 2382and Road P122-1 Project no : 12392J". The Purpose of this Meeting was todiscuss impact of Road 2382 on Radio Masts and the Radio Station. Place:Research Offices of Mr Larsen Date : 2 March 2004 . (Bokamoso have a copyof the minutes of this meeting on file).

4) Comments on Gautrans 'Legal Status'letter: This letter, setting out the 'Legal Status' of  Road 2382 AND,in particular, the sections of the road that do NOT run over servitudesregistered in favour of the public, has still not been made available tothe I&APs. We would like Mr Ivor Wells, who was the conveyancing attorneyfor the properties in question for the last 30 or more years, to have anadvance copy of the Gautrans  letter. Bokamoso is asked to place on recordthat we have been trying to resolve the 'Legal Status' of  Road 2382 with'Province' since the completion of the R21 Freeway.

5) Response to 'additional' alternativeroutes proposed by the I&APs. See documents submitted by the Interestedand Affected Parties (I&APs).

6) Response to Provisional NoiseImpact Studies: The Provisional Noise Impact Studies to be prepared bya qualified acoustician, with particular attention being given to ALL residentialproperties for EACH of the proposed routes. Note: The I&APs provisionalcalculations show that the future impact of vehicle noise on residentialproperties is a 'fatal flaw' in most of the routes proposed in the ScopingReport. Large earth berms need to be considered but may be ineffectivewith regard to the properties located on the 'Langerand' The 'Langerand'is a long north / south running ridge that lies between the R21 and theRietvlei Game Reserve. The 'Langerand', and the the flat area between theR21 and the Rietvlei Game Reserve, is seen as a buffer zone for the GameReserve and the 'Langerand' is listed as 'residential' in the BronbergIntegrated Development Framework document dated JULY 2000.
